This Privacy Policy explains how EvryBite collects, uses, shares, and retains personal information when you use the Platform.

1) Scope

This policy applies to Customers, Sellers, and visitors to our websites and apps. It does not cover third-party sites, Sellers’ own practices, or payment processors’ handling of your information.

2) Information we collect

A. Information you provide

  • Account details: name, email
  • Profile details: preferences, dietary notes (if you choose to provide them)
  • Order-related info: items reserved, pickup details, communications with Sellers or support
  • Seller onboarding info (for business accounts): business name, address, contact person, payout details, tax forms where required
  • User Content: reviews, ratings, photos, messages

B. Information collected automatically

  • Device and app data: device type, OS version, app version, identifiers, crash logs
  • Usage data: pages viewed, features used, clicks, timestamps
  • Approximate location: inferred from IP address
  • Precise location (optional): only if you enable location permissions, used for showing nearby Sellers and pickup navigation

C. Information from third parties

  • Payment providers: confirmation that a payment succeeded or failed, partial card metadata (like last 4 digits), and refund status
  • Analytics and measurement providers: aggregated insights about app usage and performance
  • Sellers: order fulfillment updates, pickup confirmations, and issue reports

3) How we use information

We use personal information to:

  • Provide and operate the Platform (accounts, orders, pickup confirmations)
  • Process payments, refunds, fraud prevention, and security checks
  • Personalize your experience (nearby options, saved preferences)
  • Communicate with you (order updates, support replies, important notices)
  • Improve the Platform (debugging, analytics, testing, product development)
  • Comply with law and enforce our Terms

4) Legal bases

Where applicable, we process personal data based on:

  • Contract necessity (to provide the Platform)
  • Legitimate interests (security, fraud prevention, product improvement)
  • Consent (marketing messages, precise location, certain analytics where required)
  • Legal obligations (tax, accounting, legal process)

5) How we share information

We may share personal information with:

A. Sellers (businesses you order from)

  • Your name and order details needed to fulfill pickup
  • Communications you send to the Seller through the Platform

B. Service providers
Vendors who help us run the Platform, such as:

  • Hosting and cloud infrastructure
  • Analytics and crash reporting
  • Customer support tools
  • Email and notification delivery
  • Payment processing and payout providers (especially for Seller accounts)

C. Donation and logistics partners
If a Seller participates in post-sale donation flows, we may share limited information needed for pickup coordination, routing, and compliance.

D. Legal and safety
We may disclose information if we believe it is reasonably necessary to:

  • Comply with law, subpoenas, or lawful requests
  • Enforce our Terms of Service
  • Detect, prevent, or address fraud, security, or technical issues
  • Protect rights, property, and safety of users, Sellers, EvryBite, or the public

E. Business transfers
If we are involved in a merger, acquisition, financing, or asset sale, information may be transferred as part of that transaction, subject to standard confidentiality protections.

6) Cookies, SDKs, and similar technologies

We use cookies on our websites and SDKs in our apps to:

  • Keep you logged in
  • Remember preferences
  • Measure performance and usage
  • Improve reliability and detect fraud

You can control cookies via your browser settings. You can control app permissions (like location) in your device settings.

7) Your choices and controls

Depending on your region and device, you may be able to:

  • Access and update your account info in the app
  • Turn precise location on or off
  • Opt out of marketing emails (via unsubscribe link)
  • Manage push notification permissions in your device settings
  • Delete your account via the app’s settings (we may retain certain records as required by law)

8) Data retention

We keep personal information only as long as needed to:

  • Provide the Platform
  • Maintain business records (transactions, accounting)
  • Resolve disputes and enforce Terms
  • Meet legal obligations

Retention periods vary depending on the data type and legal requirements.

9) Security

We use administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

10) Children’s privacy

The Platform is not intended for children under 13. If we learn we collected information from a child without appropriate consent, we will take steps to delete it.

  • Correct inaccurate information

Do we “sell” personal information?
We do not sell personal information for money. Some analytics or advertising integrations may be considered “sharing” under certain state laws. If we use such integrations, we will provide opt-out mechanisms where required.

We may update this Privacy Policy from time to time. If changes are material, we will post an updated version and may provide additional notice in the Platform.
